USER AGREEMENT

 

You must read and agree to accept all of the terms and conditions of the Honey Hole Online Flea Market web site.  The use of this web site, Honey Hole Online Flea Market, constitutes that you accept, agree, and understand all of the terms and conditions in this User agreement with Honey Hole Online Flea Market.

 

AGREEMENT MODIFICATIONS

 

Honey Hole Online Flea Market will also be known as “HHOFM”, we, us, and our in this agreement.  The Seller will mean any party who becomes a member and sells merchandise on our web site “HHOFM”.  The Buyer will be any party who becomes a member and shops on our web site.  We, “HHOFM”, reserve the right and sole discretion to modify and or change, or amend from time to time, the terms and conditions in this User Agreement.  Any and all changes or modifications will be immediately effective.  As a member, review this agreement for any change or modifications regularly.

 

MEMBERSHIP

 

To become a member with our web site you must be 18 years of age and able to enter into a legal contract.  This is a legal and binding contract.

 

REGISTRATION

 

Before you are eligible to use or become a member with “HHOFM” site, you must register by giving true and correct information on the registration form.  If the information you give is false or can not be verified, you account may be closed or suspended until it can be verified.

 

CONTENT

 

We have the sole authority and discretion and reserve the right to remove any content, posting, text, image, item, or picture from our “HHOFM” site at any time or for any reason without notice.  The Seller is responsible for each item and content they list, post, or email.  You must have legal ownership of the item you are selling, posting,  or listing on “HHOFM” site.  All information a Seller gives about an item must be truthful and complete to the best of your knowledge.

 

REPRESENTATIONS

 

We expect Seller and Buyer to deal in good faith and honor the terms of the sale.

 

CONDUCT

 

All members must agree that there will be no harassment, offensive, abusive, disruptive, harmful, threatening, unlawful, spamming, unruly, or defamatory remarks made to any other member or party.

 

THIRD PARTY

 

You understand and agree that if there is a dispute between members of “HHOFM” site and or any third party, that “HHOFM” is not obligated to be involved and you release “HHOFM” and its officers, agents, and employees from all demands and or claims.

 

VENUE/DISPUTES

 

We, “HHOFM”, have no involvement with any dealing between members and we don’t get involved in any disputes between users.  We provide an online site for members to sell or buy merchandise.  In the event there is a dispute, we ask each party to communicate with each other to resolve their disputes.  You agree to release us, “HHOFM” and all officers, employees, and agents from all and any type of claims or damages.  Before you buy anything, check out seller or buyer feedback.

 

NO AGENCY

 

You agree and understand that there is no joint venture, partnership, employee-employer, agency, franchiser-franchisee, intended or created by this agreement.

 

PROPERTY RIGHTS

 

The use of our HHOFM site does not grant you any rights to our logos, site, trademarks, or any contents.  We reserve all property rights.

 

LIMITATION OF LIABILITY

 

You understand and agree that at no time HHOFM site, officers, agents, employees, and directors, are not liable for the action or inaction of any Seller or Buyer on this site.  We are not liable for lost revenues, profits, or incidental damages resulting from this agreement or the use of HHOFM site.

 

DISCLAIMER OF WARRANTIES

 

We do not offer any guarantees or warranties.  HHOFM has no control over authenticity, value, or quality of any merchantability.  It is entirely at your own risk, HHOFM site provides an “as is” or “as available” basis. Without any warranties or guarantee of any kind.

 

INDEMNIFICATION

 

You understand and agree to indemnify and hold HHOFM, our officers, agents, employees, directors, vendors, and contractors harmless from any claim or demand, including reasonable attorney’s fees made by any third party due to or arising out of your agreement and your use with this site, HHOFM or violation of laws or right of a third party or infringement by you using this site in violation of this agreement.

 

TERMINATION OF USER AGREEMENT

 

The user agreement can be terminated at any time by HHOFM or you.  If you terminate this agreement, you can no longer use our HHOFM site.  We can suspend or terminate your account at any time if you violate the terms of the agreement, without refund of any fees.

 

NOTICE

 

All notices in this agreement between you and HHOFM will be provided via email, first class US mail, certified mail, or registered mail.  Notices we send will be to the email address you provided during registration.  We will consider email notice given after 24 hours from time the email was sent.  Unless the sending party is notified that the email address is not valid.

 

FEES

 

We at HHOFM are trying to keep to the Flea Market idea.  You rent a space and sell as many items as you like within your space (check booth space).  You pay for the space, not per item listed or a percent of what you sold the item for.  That money is all yours.  The only other fee there is apart from the booth space, is the display window, and that is only if you use it.

 

BOOTH FEES

 

We offer three different size booths.  Silver Booth-40 items with up to 5 pictures per item for $19.95 per month.  List as many items as you like but no more than 40 items at one time.  If you sell 30 in the first week or two, you can list 30 more.  Gold Booth-100 items with up to 10 pictures per item for $39.95 per month.  As in the Silver Booth, you can have 100 items in your booth at all times.  Platinum Booth-200 items with up to 15 pictures per item for $59.95 per month.  You can have 200 items in your booth at all times, and change as you need or want to.  Display Window-each item is $5.00 to put in on the Home page in the Display Window and it will run periodically for 24 hours.

 

HHOFM AUTHORITY

 

We have sole authority and discretion and reserve the right to remove any posting, item, or picture from HHOFM site at any time for any reason without notice.  If there is any dispute between Buyer and Seller , each party should communicate with each other to resolve the complaint.  As a Buyer, remember “Buyer Beware” is always a good idea.  We also reserve the right to refuse service to anyone and discontinue service at any time.

 

WHAT IS IT?

 

HHOFM provides a forum for members to ask  for help identifying an item.  By posting an item on this forum, you may use the expertise of other members to identify, date and maybe even get a value on the item.  This forum is for all members.
